During the hearing, Bascom cited several cases from Missouri Appellate Courts to support his argument that the first amended petition in quo warranto filed by Carter County Prosecutor Ernie Richardson should be dismissed for relying on the wrong statute. Richardson’s petition essentially alleges that Hoerner should be removed from office for failing to pay Missouri state income taxes.
