On May 14, 2026, the Supreme Court of the United States held that federal courts that have previously stayed claims in pending actions under Section 3 of the Federal Arbitration Act (FAA) “have jurisdiction to confirm or vacate a resulting arbitral award on those claims”—even when the motions to confirm (under Section 9) or vacate (under Section 10) do not independently present a basis for federal jurisdiction.

Quick Hits In a unanimous decision, the Supreme Court ruled that federal courts that have stayed claims in pending actions under Section 3 of the FAA maintain jurisdiction to confirm or vacate the resulting arbitral awards under sections 9 and 10 of the FAA. In this case, the original employment discrimination claims were sufficient to establish the federal district court’s jurisdiction.

Sixth Circuit Finds Sexual Harassment Claim Can Bar Entire Case From Arbitration

On February 25, 2026, the U.S. Court of Appeals for the Sixth Circuit ruled in Bruce v. Adams and Reese, LLP that employers cannot compel arbitration of a case under a mandatory pre-dispute arbitration agreement when an employee or former employee sues on multiple claims and at least one of them is for sexual assault and/or sexual harassment.
