Unbound by Statute: The U.S. Senate, California's Emissions Waivers, and the Congressional Review Act, by Greg Dotson
On June 12, 2025, President Trump signed three resolutions of disapproval in an effort to block California’s current air pollution emissions standards for cars and trucks. California and ten other states immediately filed suit in federal court, citing a number of statutory and constitutional claims in arguing that the resolutions were unlawful and asking a federal court to declare them to have no effect.
The budget rule that killed the minimum wage hike could save climate policies
In the 2021 and 2022 Congress, Democrats had a narrow Senate majority but nonetheless achieved major accomplishments through a combination of bipartisan legislation and the use of the budget reconciliation process. As chief counsel for the Senate Environment Committee, I was personally involved in some of these efforts and had a front row seat for others.

State Authority to Regulate Mobile Source Greenhouse Gas Emissions, Part 1: History and Current Challenge
97 Pages Posted: 16 Sep 2019 Date Written: September 6, 2019 Abstract In 2018, the National Highway Transportation Safety Administration (NHTSA) and the U.S. Environmental Protection Agency (EPA) proposed a dramatic rethinking of how federal laws that set standards for air pollution and fuel economy for the nation’s cars and trucks are implemented. The agencies have proposed a new reading of the Energy Policy and Conservation Act of 1975 (EPCA) which governs federal fuel economy standards.
Republican legacy on international climate policy
In 1992, the George H.W. Bush administration negotiated an unprecedented multilateral treaty, the U.N. Framework Convention on Climate Change, or UNFCCC, which received bipartisan consent for ratification from the U.S. Senate. At the time, Sen.

Analysis: Why the EPA’s shift on auto efficiency rules will give China the upper hand
The Trump administration is poised to ease pollution and efficiency rules for new passenger cars and trucks, giving automakers a reprieve from more stringent Obama-era standards. But in the process, it could yield global leadership in the auto sector to the Chinese. Environmental Protection Agency Administrator Scott Pruitt is expected to announce a plan to relax existing tailpipe standards that apply through 2025, scrapping the previous target of an average of 36 miles per gallon.

Boycott Factory Farm Foods: But Don't Forget the Fish
By Ronnie CumminsFactory farming and fish production are now a multi-trillion-dollar monster with a growing and devastating impact on public health, animal welfare, small farmers and farmworkers, rural and fishing communities, ocean marine life, water quality, air pollution, soil health, biodiversity and last but not least, global warming.Worldwide, two-thirds of all farm animals are now inhumanely imprisoned on highly-polluting factory farms, fed pesticide- and chemical-contaminated grains...

New Report Promotes Need for Fashion Industry Action
By Linda GreerThe fashion industry doesn't necessarily have the biggest nose-to-the-grindstone, follow-the-numbers reputation of an industry, let's face it. It is better known for its creativity, innovation and trendsetting. But this sector packs a major punch environmentally, let me tell you—in terms of climate impact, water use and pollution.
Say Goodbye to the Internal Combustion Engine
By Rory Christian and Larissa KoehlerElectric vehicles (EVs) don't make much noise on the road, but they're generating a lot of buzz about the future of this technology and what it means for business and the environment.Cars, buses and trucks are the second biggest source of pollution in the U.S. after electricity production.
Now Under Attack, EPA’s Work on Climate Change Has Been Going on for Decades
The Trump administration intends to roll back two pillars of the Obama administration’s climate policy — regulations to limit carbon emissions from vehicles and power plants. Under President Obama, the Environmental Protection Agency was central to these regulations. But new EPA Administrator Scott Pruitt has said he plans to return the agency to its “core mission” of ensuring clean air and clean water, rather than addressing climate change.

Building a 21st Century Economy - Center for American Progress
Climate change is a classic market failure. The price of fossil fuels does not reflect the costly effects of those fuels on the environment and climate. As long as the cost of climate change remains outside the market, the economy will consume more fossil fuels than it otherwise would if prices accurately reflected the costs and risks posed to society and the economy by greenhouse gas pollution.
Trump Tests Climate Change Denial Against Public Opinion, Real-World Impacts – ThinkProgress
As the presidential election builds to a crescendo, extreme weather has brought climate change as an electoral issue into focus. Florida is facing its first hurricane landfall in a decade, resulting in the National Weather Service issuing its first-ever storm surge warning. At the same time, Louisianans are just beginning to clean up the damage from deadly August floods.
The Republican Platform Once Tried To Fight Climate Change. Now It Denies It.
The stark difference between Hillary Clinton and Donald J. Trump on climate change is now well known. Secretary Clinton said climate change is “one of the most urgent threats of our time, and we have no choice but to rise and meet it.” On the other hand, Mr. Trump has said that climate change is a hoax. Similarly, the Democratic platform and Republican platform are practically opposites of each other.
Fixing the Foul Play
A giant logo of the German car manufacturer Volkswagen is pictured on top of a company's factory building in Wolfsburg, Germany, September 2015. State and federal agencies continue to investigate Volkswagen’s alleged efforts to cheat on emissions tests in the United States.
How The Paris Climate Agreement Unlocks A Powerful Tool In The Clean Air Act
A group of leading law professors who work on climate have published a game-changing new legal analysis. They find that the Paris climate agreement unlocks a previously unused Clean Air Act provision that gives the EPA broad authority to use market-based mechanisms to reduce carbon pollution nationwide. Last December in Paris, the U.S. committed to cut greenhouse gas emissions 26 to 28 percent compared to 2005 levels by 2025.

Rising to the Challenge
Cities are at the epicenter of climate change, responsible for as much as 80 percent of heat-trapping emissions and enduring the brunt of climate change’s effects. Unlike the polarized debate on climate change at the national level, American mayors are calling for carbon-pollution reductions and increased resiliency efforts to avoid the potential catastrophic effects of climate change.
