前 言 适用反不正当竞争法第二条裁判数据权益保护案件时，裁判路径可以大致分为权益保护范式和行为分析范式。行为分析范式，是指在裁判中不分析或者不过多分析原告是否享有应受法律保护的利益，而是着重分析被诉行为是否具有不正当性，进而得出被诉行为是否构成不正当竞争行为的裁判分析路径。司法实践中，适用行为分析范式进行裁判的案例占26.67%，原告的胜诉率为63.64%（详见 《数据权益保护研究系列文章之一 ——数据权益保护司法裁判数据分析》）。行为分析范式能够贴合反不正当竞争法的立法目的，反映市场运行机制，体现经营者、消费者及社会公众利益保护的目的，下文将以采用行为分析范式的典型案例为切入点，对这一裁判路径进行分析，并提供应对类似案件的实务建议。 一、适用行为分析范式的典型案例 司法实务中，行为分析范式主要分析行为是否具有不正当性，部分案例同时会考虑涉案数据是否构成原告的合法权益。在论述行为是否具有不正当性时，主要从行为是否违反商业道德、是否形成实质性替代、是否影响市场竞争机制、是否导致社会总体福祉下降等多种方面进行综合判断。...
