Recent Third Circuit Case Highlights Business Risks of AI-Driven Algorithmic Pricing
Companies of all sizes and across every sector, including banking and financial services, have been scrambling to integrate artificial intelligence into their business models and day-to-day workflows. The possibilities offered by AI have seemingly driven companies and employees into an adoption frenzy. But the rush to drink from this digital fountain of youth is not without risk, as a recent case shows. Imagine that sales teams at competing companies use the same AI-driven pricing model.
Second Circuit Again Holds State Escrow-Interest Law Preempted and OCC Finalizes Rulemaking in Attempt to Avoid Circuit Split
The post-Cantero battle over state mortgage escrow-interest laws continues to deepen, with significant implications for national banks’ mortgage servicing practices, pricing flexibility, and exposure to consumer class actions. The Second Circuit recently reaffirmed its prior holding that New York’s escrow-interest law is preempted, and the OCC issued new rulemaking designed to bolster preemption defenses and affect national uniformity.
Banks Beware: Sureties Can Leapfrog Your Security Interest
All banks operating in Minnesota must be aware of the recent decision in United Prairie Bank v. Molnau Trucking LLC. In that case, the Minnesota Supreme Court significantly reshaped the priority landscape between secured lenders and sureties in the public construction market. In brief, the Court held that a performing surety’s rights take priority over a bank’s perfected security interest in contract funds—even where the bank was first-in-time under the UCC.

Building a better natural killer (NK) cell: Fc receptor engineering strategies for NK cell therapeutics
KEYWORDS: Natural killer cell cell signaling NK cell therapeutics cell engineering Cell-based therapeutics have experienced a rapid expansion in applications since they first entered clinical trials in the late 2000s. While chimeric antigen receptor (CAR) T cells have largely led the field, attention has increasingly shifted toward natural killer (NK) cells as additional versatile platforms for next-generation cell therapies [Citation1].
Act Fast Or Lose Interest: New Court Decision Tightens Deadlines | JD Supra
The Minnesota Supreme Court recently issued a new decision that affects the ability to obtain pre-judgment interest, except as otherwise provided by contract (such as loan documents), and cuts off the ability to obtain that interest (at a rate of 10% per annum in most cases) if a non-contractual claim is not commenced promptly.
Do You Use Packaging? If So, You Need To Know About Minnesota's New Packaging Law And The Upcoming Deadline Of July 1, 2025 | JD Supra
Minnesota is now the fifth state—joining Maine, Oregon, Colorado, and California—to pass what are called “extended producer responsibility” laws, in line with a growing trend across the country [1]. In 2024, Minnesota enacted the Packaging Waste and Cost Reduction Act[2] (the “Act”). The stated goal of this legislation is to encourage sustainable design, while addressing the environmental effects of products brought to market.
Transformation and New Purpose: How Courts Are Applying Fair Use After Goldsmith v. Warhol
Catherine Falls Commercial via Getty Images In May 2023, the U.S. Supreme Court’s decision in Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith reshaped the understanding of the primacy of “transformative” use in copyright law. The case centered on whether Andy Warhol’s orange silkscreen artistic adaptation of Lynn Goldsmith’s photograph of Prince was sufficiently transformative to favor application of the fair use defense.

First Minnesota Court Decisions on Overdraft Fees Are Wins for Banks | JD Supra
In December 2021, the Consumer Financial Protection Bureau (CFPB) released research critiquing banks for charging overdraft and related fees to consumers, and the CFPB director, Rohit Chopra, stated the agency would renew its focus on investigating these fees.[1] As I predicted at that time, this regulatory focus on overdraft fees inspired civil litigation and increased legal risk for banks and financial institutions.[2] Plaintiffs filed several lawsuits in Minnesota (and elsewhere) against...

Eighth Circuit First to Apply “Manifested Defect” Rule to Class Action Fairness Act | JD Supra
[co-author: Chris Cerny - Summer Associate] This month, the Eighth Circuit Court of Appeals issued what appears to be the first appellate opinion applying the “manifested defect” rule to the Class Action Fairness Act’s (“CAFA”) $5 million amount-in-controversy requirement. The manifested defect rule generally states that consumers who do not experience a defective condition cannot bring product defect claims. While the rule is not new, its application to class actions in federal court is.
Eighth Circuit Reinforces Trend Denying Insurance Coverage for COVID-related Loss | JD Supra
[co-author: Tess Olinger - Summer Associate] In the wake of COVID-19 and governmental closure orders, many businesses were forced to temporarily suspend their operations. Consequently, many consumer-facing businesses lost out on a significant source of income. As previously predicted, some of these business turned to their Commercial General Liability (“CGL”) insurance policies to seek coverage for these losses. After insurers denied coverage, these businesses brought suit.

Rivian's F-150 Masquerade: Fair Use or Trade Dress Infringement?
A little over one year ago, I blogged about Tesla’s Roadster being launched into outer space, asking who owns the right to the “Spaceman” rider’s mark? Today I post a different thought-provoking question about electric car company Rivian: Does Rivian’s use of a Ford F-150 body when testing its electric truck technology in public risk trade dress infringement?

If an Alligator Infringes a Beaver Mark, Will a Cowboy?
You might recall that several months ago, we blogged about an intriguing trademark infringement battle between Buc-ee’s and Choke Canyon. In June 2018, the Texan rivals competing in the over-sized gas station market–a real niche, to be sure–went to trial, with Buc-ee’s arguing that Choke Canyon’s alligator logo infringed Buc-ee’s beaver mark: Incredibly, the Texan jury found in favor of Buc-ee’s.

Just Which "Wayne" Are We Talking About?
Who comes to mind when I list the following character traits: lives in a dystopian metropolis, has a deceased parent, fights criminals, rides a motorcycle, has seemingly-superhero strength, is fearless, has dark hair, and–oh, by the way–his name is “Wayne.” More than that, you learn all these facts about Wayne by watching a trailer for a series about Wayne on YouTube, which informs you throughout that Wayne is a character “from the guys who wrote Deadpool,” a fictional superhero.

What Is in a Name? That Which We Call Heisman; by Any Other Name Would Be Ambiguous
It’s fall, and you know what that means: football season! For many, this means a return to the couch each weekend to spectate America’s most-watched sport. But the popularity of doing so appears to be in decline. This shift isn’t only affecting the NFL, but also college football as well, as ticket sales continue to plummet. Increasingly among my own family and friends, it seems as if everyone is more interested in playing their fantasy leagues than watching reality unfold before them.

After Battles for Fees, Victory for Comic Con and (partially) Grumpy Cat
The battle for attorneys’ fees after an intense trademark dispute often leaves many prevailing parties empty handed. This is because the Lanham Act only provides for attorneys’ fees in “exceptional cases.” Congress’s (and courts’) reluctance to award attorneys’ fees stems from the “American Rule,” which provides that each party to a lawsuit is responsible for paying its own fees–unless a statute provides otherwise.

Can a YouTube Video Invalidate a Patent? It's Certainly Possible
One of the most common defenses to patent infringement is that the asserted patent is invalid. The reasons for invalidity regularly range from lack of utility, to incorrect inventorship, and even to fraud (as I’ve recently written about).

Glade No. 1, 2, 3, 4, and... Chanel No. 5?
Recently, a friend and I were watching The Bachelor—I know, I should be ashamed. During one of the commercial breaks, a spot appeared on-screen showing a woman wearing an elegant dress walking through a hallway. She turns into a doorway, and blue, shimmering light projects onto her face, as if she was underwater. A speaker off-screen says, “Open the door to a beautiful new experience for your home.” The commercial cuts to a small bottle with a spray nozzle on top.
