kcrg.com — DUBUQUE, Iowa - The sentence for a man who pleaded guilty to charges of robbing a bar and shooting a Dubuque police officer in 2009 has been vacated and sent back to the court for resentencing - for a second time. A decision released Wednesday from the Iowa Court of Appeals ruled in favor of Eddie Chest's claim prosecutors breached the plea agreement by not recommending the sentence agreed upon by both sides. "The prosecutor failed to make a meaningful recommendation consistent with the terms of the plea agreement," wrote judge JJ McDonald in the opinion of the three-justice panel.
