Eleventh Circuit Clarifies Legal Standard in EPA Pay Discrimination Case
By Robert Meyer The Equal Pay Act of 1963, 29 U.S.C. § 206(d) (“EPA”) requires men and women to receive equal pay for equal work. In order to assert a claim under the EPA, an employee must show that she was paid less than a male comparator working, in this case a male working in a substantially equal job. But does the employee also have to prove that the employer’s reasons for the alleged pay disparity between herself and the male comparator were a pretext for gender discrimination?
Fourth Circuit Rejects Plaintiff's
The Equal Pay Act (EPA) and Title VII of the Civil Rights Act generally prohibit covered employers from discriminating against employees on the basis of sex with regard to compensation. The EPA requires men and women to receive equal pay for equal work in the same establishment. Thus, in order to prove a violation of the EPA, a claimant must show that she was paid less than a male comparator working in a "substantially equal" job.

The ADA refers to possible forms of accommodation, such as job restructuring, modified work schedules, and transfer to a vacant position.
