Secretary of State for Justice makes important concession on Category A reviews

Last month the Secretary of State for Justice accepted in judicial proceedings brought by a Category A prisoner that when undertaking a Category A review, he is under a duty to attempt to resolve disputed factual allegations which are material to the decision, i.e. disputed factual allegations going to the issue of risk. The sealed Consent Order from Lang J can be found here. The Claimant had challenged the Defendant’s refusal to downgrade him from Category A.

High Court finds that segregation of prisoner amounted to cruel, inhuman and degrading treatment

Today, Mr Justice Sheldon handed down judgment in R (Sahayb Abu) v Secretary of State for Justice, finding in favour of Mr Abu on each of his five grounds of judicial review. Mr Abu challenged the lawfulness of the Secretary of State’s repeated decisions to segregate him following an attack on prison officers by another prisoner on 12 April 2025.
