Queens Court Declines to Dismiss Subrogation Action, Finding Issues of Control Over Uber Driver | JD Supra

The Civil Court in Queens County, NY denied Uber’s motion to dismiss a subrogation action stemming from a motor vehicle accident. Uber argued it could not be held vicariously liable for the defendant driver’s actions as he was an independent contractor. The court found that there remained issues of control to be resolved in the litigation. Specifically, the court pointed to Uber’s compliance protocols, required background checks and vehicle standards, use of branded materials, and driver ratings.

Federal Court Shields Lyft from Liability in Driver Altercation, Citing Independent Contractor Status | JD Supra

The United States District Court for the Northern District of Georgia granted summary judgment in favor of Lyft in a personal injury claim stemming from an altercation involving a Lyft driver. The court found that the driver was an independent contractor and noted that the employer of an independent contractor generally cannot be held liable for the independent contractor’s conduct. The court rejected the plaintiff’s contention that Lyft owed a non-delegable duty.
