A Vendor's Breach Can Still Be Your Bank's Problem
Banks need to remember that they are the ones regulators hold accountable for data security related to their customers' private financial information, but most often their vendors are the ones responsible for the breach. Without contract terms that require the vendor to notify the bank of a breach in a timely manner, it may be difficult for the bank to meet its legal obligations for notifying its customers of the breach.

This month, we visited our nation’s capital with the Mississippi Bankers Association for its annual “fly-in,” which is a week when Mississippi bankers hear from federal regulators as to their enforcement priorities and speak with their congressional delegation as to their bank policy priorities.
You're Gonna Need a Bigger Boat Part 2: US Fifth Circuit Addresses the SPVA Amendments to the Limitation of Liability Act
In January 2023, we reported on the 2022 amendments to the Shipowners’ Limitation of Liability Act, 46 U.S.C. § 30501, et seq. (Limitation Act), wherein Congress removed “covered small passenger vessels” from the ambit of the Limitation Act’s protections pursuant to the Small Passenger Vessel Act (SPVA).

WSJ Article on New Tokenized Deposits
In my opinion, this is the future of digital commerce in our economy. It utilizes our existing finance infrastructure and, unlike stablecoin, still allows for leverage and money creation through the banking system, which is critical to our national and local economies. As I heard in the theatre recently, “this is the way.” Banks tend to favor tokenized deposits over stablecoins because they are simply traditional bank deposits represented as digital tokens on the blockchain.

Stablecoins, Deposits, and the Future of Community Banking
When I was a young community banker, I volunteered for a program sponsored by our state bankers’ association called “Banker in Every Classroom.” This was in 2012, when public opinion of bankers was at an all time low following the Great Recession. As we know, this criticism often unfairly targeted community bankers — professionals who weathered the recession but did little to cause it.
Australia’s anti-greenwashing law offers a model for Canada
Has Canada’s anti-greenwashing legislation got your legal team feeling like they’re ready to “go walkabout”? They wouldn’t be alone. But that’s no reason to throw these new competition rules in the “dunny” just yet. We can take a lesson from our mates in Australia who are swiftly adding sustainable finance as a claim to fame along with sensational natural beauty and colourful idioms.
Automated Teller Machines Under Federal Deposit Insurance Act
When I entered community banking, one of my least favorite responsibilities was servicing the automated teller machines (ATMs). As a young officer at a small community bank, I, along with a few of our other young officers, was tasked with resupplying the bank’s local ATMs with cash, scheduling maintenance on them when they went down, and rotating being “on call” for responding to after-hours ATM problems that arose from time to time.
Defending Against Third-Party Risks Posed to Your Bank
On leap day, Feb. 29, I was fortunate to participate as a member of a distinguished panel discussing third-party risk management for banks at the 2024 Banking Outlook Conference hosted by the Supervision and Regulation Division of the Federal Reserve Bank of Atlanta in conjunction with the Graduate School of Banking at Louisiana State University.

NSF Fees on Re-Presented Items May Be Unfair Even When They Are Not Deceptive
For a little over a year now, banks and their regulators have exhibited an unprecedented amount of focus on non-sufficient funds (or NSF) fees charged on checks or ACH entries that are presented multiple times for payment from a consumer’s deposit account that does not have a large enough balance to pay it.

New Focus On Liquidity Displayed by Bank Examiners
In 2008, as the Great Recession was beginning, I made a career U-turn and exited the practice of law to move back home and work with my father in a small community bank. One day in my first few weeks there, my phone rang, and it was a banker with whom I had worked while at my prior law firm, calling to scold me for not telling him I was leaving. This gentleman, who had been a friend of my grandfather, was a rather gruff executive, possibly even a curmudgeon at times.

Writing Python functions that someone else would enjoy using
The best function does what it says - nothing more, nothing less. Unfortunately, without documentation, functions say nothing at all. If you implement a function simply like the following, it will work. def get_c(side_a, side_b): return (side_a**2 + side_b**2)**0.5 But when you go to use it, the tooltip in your IDE (VS Code in this case) will be useless. If the best function does what is says, then this one can't be good because it says nothing at all.

The Downsides of Procrastination in Shareholder Activism
Thursday, October 28, 2021 I heard a good talk recently about addressing life’s problems, and it included an analogy that I thought was a great illustration of how procrastination usually multiplies problems instead of solving them. The speaker said that she lives near the water, and her family enjoys all the recreational advantages that it offers, including canoeing. She admitted, though, that one threatening aspect of that lifestyle is the reptiles that find their way into her yard.
Why the future of long-haul heavy trucking probably includes lots of hydrogen
The climate crisis requires that we decarbonize our global transportation systems. To meet this requirement, the purported solution for some time has been "electrify everything." Technical experts and the climate-concerned public alike have long pushed the idea that the future will be one of clean electricity that powers just about all aspects of our life. I bought in — at least for a time.

CFPB Issues New Proclamations Under Biden Administration
Thursday, April 22, 2021 One of my treasured childhood memories is of the summertime, when my father would come home from the bank for lunch and turn on a rerun episode of his favorite TV sitcom, The Andy Griffith Show. To my delight, within the past couple of years, my children have discovered these reruns, presumably while looking for something to occupy their time when avoiding homework during an imposed video game moratorium.

Regaining the Banks’ Flight Control Monitors to Navigate the COVID-19 Storm
Thursday, September 10, 2020 I only spent six years within a community bank, but considering when those years fell (i.e., from April 2008 to June 2014, during the thick of the Great Recession), I learned an awful lot about credit risk management, even though I was only incidentally involved in the credit management function as a member of the management loan committee and the board of directors.

4 Tips to Improve your pricing strategy
The price of your products or services can have a direct impact on your business’s performance. Pricing decisions dictate your margins and bottom line, and they also determine the brand’s acceptability and customer base. Many B2B and B2C businesses use pricing strategy tactics to sharpen their competitive edge, narrow their niche, or strengthen their market dominance. The cost of a product or service significantly influences consumer purchasing decisions.

Digital Payment Forms, Analogue Commerce Laws
Thursday, April 18, 2019 A few years ago, my family and I visited Disney World for the first time, and I quickly learned a very important lesson about the park: nobody who is anybody at Disney pays for anything with cash or a debit card. For those who are staying at one of the resort, stylish wristbands are the preferred form of payment. These wristbands, which apparently come in an array of colors and styles, store all kinds of information about the Disney patrons they belong to.

(TeaParty.org) – There is a way in which illegal immigration is like war. When you cross the border of a soverign nation in hoardes, it’s a lot like an invasion. Rep. Kyrsten Sinema, who is currently running for Senate in Arizona, however, apparently thinks that to invade a nation like this is just as valiant as what US troops have done globally to secure liberty for countless millions of people throughout our stunning military history.
Battle Ground school district residents need a break
It's time to give the average homeowner a well deserved break. I haven't had any kids in the school system for about thirty years, but I still have to pay outrageous property tax. It's bad enough that the Battle Ground school board secretly met and gave our previous superintendent a $400,000 buy off so she would leave the school. This was kept secret because a bond vote was coming up and they didn't want to see it fail, which it would have if taxpayers would have known about it.
CWA Communications Workers of America : Tennessee Campus Workers Foil Billionaire Governor's Outsourcing Scheme
This article was originally published in Labor Notes and is republished with permission. Two years ago Tennessee's billionaire governor Bill Haslam, then the richest elected politician in the country (now it's Trump), quietly initiated the largest and most radical restructuring of public services in the state's history. His plan was designed in secret and written as an executive action, deliberately excluding legislators and the public.
