Brazil’s discriminatory behavior has even prompted a Section 301 investigation. Trump Signs Homebuyers Privacy Protection Act into Law

On September 5, 2025, President Trump signed into law the Homebuyers Privacy Protection Act, H.R. 2808 (the “Act”), which amends the Fair Credit Reporting Act (“FCRA”) by restricting consumer reporting agencies (“CRAs”) from furnishing “trigger leads” except in certain limited circumstances. A “trigger lead” occurs when a lender pays a CRA to produce consumer reports on a specific list of consumers that meet certain criteria provided by the lender.

Union Pacific–Norfolk Southern: A Merger That Strengthens Competition Where It Counts

When evaluating mergers, the law demands a balance: protecting competition while allowing efficiencies that benefit consumers. The proposed Union Pacific–Norfolk Southern merger, now before the Surface Transportation Board (STB), will test whether regulators can apply that balance in a fact-driven way. Unlike most mergers reviewed by the Justice Department or Federal Trade Commission, railroads fall exclusively under the STB’s jurisdiction.
