It has been said that a good prosecutor can get a grand jury to indict a ham sandwich. Apparently, that’s not the case in very red Collin County, Texas, where a self-described recovering alcoholic fatally shot his daughter in the chest, only to be the beneficiary of a particularly lenient grand jury. As a retired justice of the New York State Supreme Court, the case intrigued me and I tried to understand why the prosecutor had failed to obtain an indictment against him.

Commentary: Judicial independence over judicial sycophancy

While the president of the United States has the power under Article II, section 2 of the United States Constitution to appoint justices of the Supreme Court and other federal judges, all of whom have lifetime tenure, the president must exercise this power with the “Advice and Consent” of the Senate. The Senate’s advice and consent cannot be meaningfully exercised without the chance to question judicial nominees.

The Senate's advice and consent cannot be meaningfully exercised without the chance to question judicial nominees. Thus, a key component is the confirmation hearings during which senators question the president's nominees.
