NSWCA confirms counterfactuals are a matter of 'proving' the 'probability' of causation
By Bridget Wall and Daniel Simpson The New South Wales Court of Appeal has overturned the judgment against HWL Ebsworth Lawyers in the decision of Bluth v Boyded Industries Pty Ltd. It found the client’s loss wasn’t caused by the breach of duty when the solicitor failed to advise that lodging a caveat (in accordance with their client’s instructions) would entitle the other parties to terminate the deed.
It’s all in the construction: Zurich Australia Insurance Ltd v FKP Commercial Developments Pty Ltd [2023] FCAFC 188
The Full Court of the Federal Court of Australia has dismissed an appeal by Zurich Australian Insurance Limited (Zurich). This appeal challenged a prior ruling that determined FKP Commercial Developments Pty Limited (FKP Commercial) had the right to coverage for ‘claim expenses’.

Successfully proving the causation counterfactual: it’s all in the evidence
By Bridget Wall and Daniel Simpson In the latest decision on solicitors’ negligence, the Supreme Court of New South Wales in the matter of Boyded Industries Pty Ltd v Bluth & Ors[1] found against a solicitor for failing to advise his client that lodging a caveat (in accordance with their client’s instructions) would entitle the other parties to terminate the deed.
Region‐based epigenetic clock design improves RRBS‐based age prediction
Annotation of regional blood clocks with published blood clock sites, GC counts and other metadata Annotation files for the 5 kb RegBC and eps1000 DRegBC were initially created using SeqMonk and collated in Table . For example, to annotate the 5 kb RegBC with another clock, such as the Petkovich clock, the “Feature Probe Generator" in SeqMonk was used to generate probes based on each of the Petokvitch clock sites.
Tfap2b specifies an embryonic melanocyte stem cell that retains adult multifate potential
Highlights • Tfap2b and its target genes specify McSCs with mixed pigment cell identities • Melanocyte regeneration from McSCs functionally depends on Tfap2b • tfap2b specifies ErbB-dependent McSCs at the stem cell niche • Fate mapping reveals Tfap2b-McSCs have multifate potential for adult pigment cells Summary Melanocytes, the pigment-producing cells, are replenished from multiple stem cell niches in adult tissue.
Specific NLRP3 Inhibition Protects Against Diabetes-Associated Atherosclerosis
Complications Abstract Low-grade persistent inflammation is a feature of diabetes-driven vascular complications, in particular activation of the Nod-like receptor family pyrin domain containing 3 (NLRP3) inflammasome to trigger the maturation and release of the inflammatory cytokine interleukin-1β (IL-1β).
On the Most Misunderstood Aspect of Yoga
The best-known parts of the yogic body are often the most misunderstood. Chakras are subtle “wheels” along the spine, originally used as concentration points. They only really exist if imagined into being. Some teachings on yoga neglect them completely. There are many different systems of chakras, with varying numbers and locations. The predominant model today, with six along the spine and a seventh at the crown, is a mix of tradition and recent invention.

African-American men with low-risk prostate cancer treated with radical prostatectomy in an equal-access health care system: implications for active surveillance
Abstract Background There is concern that African-American men (AA) with low-risk prostate cancer may present with more aggressive disease and thus may not be candidates for active surveillance (AS). However, it is uncertain if poorer outcomes are due to disparities in access to medical care rather than true biological differences.
