In United States v. Gomez, __ F. 4th __, 2025 WL 3199468, an appeal of a motion to dismiss the indictment, the Second Circuit (Kearse, Jacobs, Lohier) upheld the constitutionality of 18 U.S.C. § 922(k), the federal statute forbidding possession of a firearm with a removed, obliterated, or altered serial number. The Court held that Section 922(k) does not infringe upon the right to bear arms protected by the Second Amendment.
