Four Democrats are challenging a public notice on campaign ad rates issued by the Federal Communications Commission, saying the guidance is inconsistent with federal law and the agency’s own regulations. It’s not clear that the US Court of Appeals for the Fourth Circuit will reach the merits of the challenge, as it spent most of Friday’s argument dealing with whether the notice amounts to final action, and whether or to what extent what the agency thinks matters.
