"New" FLSA white-collar exemption amendment will conform to court decisions

Making it official. Today the Wage and Hour Division of the U.S. Department of Labor will publish a technical regulatory amendment to rescind a Biden-era rule on the white-collar exemptions from the minimum wage and overtime requirements of the Fair Labor Standards Act. The Biden rule, which had been vacated by two federal courts, would have substantially increased the minimum salaries required to qualify for the exemptions.

Proposed regulations for joint employers under FLSA, FMLA, and migrants are back

Comments are being accepted through June 22. The U.S. Department of Labor Wage & Hour Division has issued a Notice of Proposed Rulemaking on the criteria for determining joint employer status under the Fair Labor Standards Act, the Family and Medical Leave Act, and the Migrant and Seasonal Agricultural Worker Protection Act. As you may recall, the DOL under the first Trump Administration published a Final Rule in January 2020 on this same subject.

Déjà Vu All Over Again: Wage & Hour Division proposes new independent contractor regulation | JD Supra

For the third time in five years, the Wage & Hour Division of the U.S. Department of Labor has published proposed regulations to define who is an independent contractor and who is an employee under the Fair Labor Standards Act, the Family and Medical Leave Act, and the Migrant and Seasonal Agricultural Worker Protection Act. The WHD published the notice of proposed rulemaking and request for public comment on Friday. Unless later extended, the comment period will close on April 28.
