In brief The Full Bench of the Federal Court has provided a timely (if not belated) reminder that employees who are covered by the Fair Work Act 2009 have a clear entitlement to be absent from work on public holidays (and paid during their absence). An employer can request that an employee works on a public holiday. However, an employee may refuse the request if it is not reasonable or the refusal is reasonable.
