SC ruling on JSW-Bhushan steel is a case of clever lawyering. It'll hurt investor confidence
Most importantly, the court condemned JSW’s conduct as mala fide, observing that it misused the process of the law and failed to fulfill its commitments after securing CoC approval. The court found that it was especially reprehensible that JSW did not abide by its commitment to make upfront payments as per the Resolution Plan, and that it ought to be held responsible for delaying the payment to financial creditors and operational creditors.

By Extending Sanjay Mishra's Tenure, Supreme Court Undermined Its Own Authority
The court’s reliance on an unexplained notion of “national interest” is a serious concern. For impactful stories you just can’t miss Last week, the Supreme Court accepted the Central Government’s submission in favour of a further extension to the current Director of the Enforcement Directorate (ED). While the order of the Court records the submissions advanced by both sides, ultimately the Court’s reasoning hinges on an unclear and unsubstantiated notion of “the larger national interest”.

New SC Judgment On Membership Under UAPA Renders the Act More Draconian
Last week, a three-judge bench of the Supreme Court overruled three judicial precedents to declare that even passive membership of an unlawful association so declared by the government will attract punishment under Section 10(a)(i) of the Unlawful Activities Prevention Act, 1967 (UAPA). This judgment removes one of the few potential safeguards against the overbroad provisions of the UAPA – an Act notorious for its capacity to be employed by governments in a bid to stifle dissent.
Demonetisation: Majority Verdict Raises Crucial Concerns Over Judiciary's Role
The majority sought to justify applying purposive interpretation on the ground that a plain meaning interpretation results in an absurdity. While the avoidance of an absurd result is also a key principle in legal interpretation, the majority failed to explain the absurdity accruing from a plain meaning approach, except to suggest that it is absurd that the Government’s power could be confined when the broad purpose of the statute is to confer power on the Government to regulate currencies.
Supreme Court Hijab Verdict: Split on Judicial Approach & Constitutional Vision
Discipline, But Not Be at the Cost of Freedom & Dignity: Justice Dhulia Aside from carefully scrutinising the State’s emphasis on discipline, Justice Dhulia’s judgment grapples with the substantive content of the rights that were sought to be balanced away in the name of discipline. At the heart of the issue lies the value of dignity that connects religious autonomy and freedom of speech and expression.

How the Supreme Court's Abortion Judgment Strengthens the Right to Autonomy
Earlier this week, the Supreme Court issued its reasons for allowing an unmarried woman to terminate her pregnancy within the 20-24 week timeline provided under Section 3(2)(b) of the Medical Termination of Pregnancy Act (“MTP Act”). The court held Rule 3B of the MTP Rules, which specifies the categories of women who can seek an abortion beyond 20 weeks, must be interpreted to include unmarried women as their exclusion would violate the right to equality.

Karnataka HC Hijab Verdict Lacks Reason, Makes Up Baseless New 'Rules' on Rights
The Karnataka High Court has delivered its final verdict on the constitutionality of the state government order banning the wearing of hijabs in educational institutions. Unfortunately, the final verdict is wrapped in many of the same misconceptions regarding fundamental rights that were evident in the court's interim order passed last month. In its verdict, the high court framed four questions in the case and decided all of them in favour of the state government.
Calcutta HC Pushes Back Against Normalisation of Internet Shutdowns

The judicial role in improving lawmaking
Rushed laws, rendering Parliament a rubber stamp, sacrifice core ideals of a constitutional democracy The deterioration in the quality of deliberation in Parliament over time has prompted calls for reform from different stakeholders. On Independence Day, Chief Justice of India (CJI) N.V. Ramana also highlighted this problem, noting that the ambiguities and gaps in laws passed without meaningful deliberation trigger avoidable litigation.
Central Vista Ruling Sets Dangerous Precedent for Judicial Review
The Correct Approach Is A ‘Third’ Approach Having failed to appreciate how the petitioners’ submissions were grounded in fundamental rights doctrine, the majority judgment then proceeded to make observations about the scope of judicial review in the abstract. In particular, it cited several precedents to argue that in cases involving “policy decisions” the Court has a severely limited role.

Why Shaheen Bagh Verdict Threatens Rights & Favours Restrictions
On Wednesday, 7 October, months after the protestors at Shaheen Bagh had vacated the site, the Supreme Court decided a petition seeking their removal. The main ground of the petition was the idea that protestors blocking a public road is not permissible in our constitutional regime. The Court’s decision raises important questions over what the Constitution means and whose rights it upholds.
In Deciding Final-Year Exams, Did SC Give Enough Say to Students?
Uniform Deadline for Entire Country Unnecessary? While evaluating whether or not the decision to set a uniform deadline for exams was arbitrary, the Supreme Court failed to actually assess the argument advanced by the petitioners. The petitioners and states argued that the decision to set a uniform date across the country was arbitrary because circumstances differed across the country.

Re: Evaluation of Cancer Specific Mortality with Surgery versus Radiation as Primary Therapy for Localized High Grade Prostate Cancer in Men Younger than 60 Years
Ranjan Gogoi had raised important questions about Supreme Court. It’s time to address those concerns
A series of events during Dipak Misra’s tenure as Chief Justice of India put the spotlight on the discretion vested in that office. It is worth remembering that the clarion call for reform was first sounded by four judges of the Supreme Court in a historic press conference in Delhi in January. However, two benches of the apex court seemed to push back at this through judgments that reiterated that the Chief Justice of India is the “master of the roster” and “an institution himself”.
Defining Dignity
With decisions on Aadhaar, IPC 377, and the right to privacy, the Supreme Court (SC) has reaffirmed the centrality of human dignity to the Constitution. The concept was invoked 120 times in the privacy decision, and 128 times in Navtej Johar. Despite the enthusiasm of the courts, there is growing scepticism about the application of dignity. The SC’s application of dignity perhaps reflects the commitment in the Universal Declaration of Human Rights. The value of dignity, however, is contestable.
Bladder changes after catheterizable channel creation in adults with cerebral palsy who are in chronic urinary retention
Cerebral palsy (CP) is characterized by motor impairments as a result of brain injury during development. Patients can have neurogenic bladder dysfunction and are often unable to catheterize through their native urethra. Catheterizable channel (CC) creation can facilitate clean intermittent catheterization (CIC). We have observed that patients with large capacity, low‐pressure bladders can develop de novo neurogenic detrusor overactivity (NDO) postoperatively.

However, the listing of sensitive cases is only the tip of the iceberg.

Re: Richard J. Sylvester, Steven E. Canfield, Thomas B.L. Lam, et al. Conflict of Evidence: Resolving Discrepancies When Findings from Randomized Controlled Trials and Meta-analyses Disagree. Eur Urol 2017;71:811-9 - European Urology
The article by Sylvester and members of the European Association of Urology guidelines leadership team addresses the intriguing issue of conflicting evidence from individual, large, and well-designed randomized controlled trials (RCTs) on the one hand and systematic reviews (SRs) on the other [1][1]. While we agree with most of the statements made, we are concerned that some issues are not laid out as clearly as they could be.
Improved Reporting of Randomized Controlled Trials in the Urologic Literature
Well-designed randomized controlled trials (RCTs) have the potential to provide high-quality evidence to inform questions of therapy and prevention, but this potential is contingent on the use of appropriate methods and transparent reporting. To systematically assess the quality of urology RCT reporting and identify trends over time. All RCTs published in four leading urology journals in 2013 were identified and compared to a prior analysis of studies from 1996 and 2004.
